That’s according to a criminal complaint filed Thursday in Olmsted County Court. The court filing indicates he was asked to leave and not return to the property the day before the alleged burglary.

Rochester Police responded to Pax Christi Church in the 4100 block of 55th St. Northwest on Tuesday to respond to the report of a man, identified as 33-year-old Kyle James Waldvogel, attempting to break into the donation box, the complaint says.

A member of the church’s staff told police she was cleaning around 8:10 a.m. Tuesday when she saw Waldvogel attempting to break open the locked donation box at the building’s front entrance, according to the court document.

Another staff member told police he encountered Waldvogel in the church’s basement on Monday removing food from the refrigerator. He reported telling Waldvogel to leave and that he was not welcomed back, the complaint states.

A third staff member at the church told officers she was Waldvogel on the church’s property yelling at her and that she knew he was on the property to try and steal, the court filing says.

The complaint says officers attempted to arrest Waldvogel the day before the alleged attempted donation box theft at his apartment. Waldvogel did not answer the door or officers commands and police decided to abandon the arrest attempt due to safety concerns.

Officer set up surveillance at Waldvogel’s apartment and arrested him on Wednesday. Waldvogel was charged Thursday with a count of felony second-degree burglary
