Rochester, MN (KROC-AM News) - A dispute at the drive-thru window of a Rochester restaurant on Sunday resulted in a felony assault arrest.

According to court documents, Rochester Police officers were dispatched to a local restaurant in response to a report concerning a belligerent customer. When they arrived, a female employee indicated she and a drive-thru customer got into a verbal altercation which ended with a refusal of service.

The employee told the officers the customer, later identified as 29-year-old Alonzo Darnell Kelly, then parked his vehicle and entered the restaurant brandishing a baseball bat. He allegedly threatened the employee by saying, "you must really like your job. I see you walk in and out of your place every day. I'll be waiting for you when you get done with work and you'll get what is coming to you."

The criminal complaint says the employee stated that Kelly was holding the baseball bat in a menacing manner and she feared "imminent physical harm." She told the officers that she then sought safety in the rear of the restaurant and contacted law enforcement.

Rochester police reported that the employee provided them with the man's license plate number and he was located a short time later near the business. The charges say that, while speaking with the officers, he admitted entering the restaurant with a baseball bat after he was refused service.

When the officers moved to place Kelly under arrest, he allegedly resisted and attempted to kick the officers. The criminal complaint says that his actions forced the officers to take him to the ground to subdue him. It also states that the officers recovered the baseball bat that he brandished in the restaurant.

Kelly was arraigned in Olmsted County Court today on a second-degree assault charge, a gross misdemeanor charge of obstructing the legal process, and a misdemeanor assault charge. His conditional bail was set at $20,000.
