With the holiday season here, it's important to be sober on the roads. Extra DUI enforcement is happening now across the country. A recent study shows which states have the highest DUI arrests per 100,000 people. Where do Minnesota and Wisconsin rank for DUI arrests?

The study was done by Denver accident attorneys at the Law Firm of Jeremy Rosenthal. They took data from the FBI Crime Data Explorer from 2023 and then scaled it for a per capita 100,000 people.

South Dakota Was The Worst State For DUI Arrests

South Dakota had 5,673 arrests. When scaled for 100,000 people, it's 748.13 arrests per 100,000 people, which is 163% higher than the national average. Yikes, South Dakota.

Minnesota Makes Top Ten For States With DUI Arrests

Minnesota had 21,574 DUI arrests in 2023. That equates to 378.85 per 100,000 people.

Top Ten States With DUI Arrests

  1. South Dakota
  2. Mississippi
  3. Wyoming
  4. North Dakota
  5. Alaska
  6. Idaho
  7. Nebraska
  8. Minnesota
  9. Nevada
  10. Montana

Wisconsin lands at number 11 on the list for DUI arrests.

Wisconsin and Minnesota have very similar arrest rates for DUIs. Wisconsin was number 11 on the list with 326.85 per 100,000.

States with the least DUI arrests:

  • Delaware (28.64 per 100,000)
  • Louisiana (84.2 per 100,000)
  • Ohio (121.05 per 100,000)
  • Massachusetts (121.49 per 100,000)
  • New York (123.95 per 100,000)

Enforcement factors in with arrest amounts.

You could argue that there is more enforcement in some of these states which would lead to higher DUI rates. Also, rural areas with less public transportation options is clearly a factor with the top 10 states for DUI being very rural.
